STORE TERMS & NON-EXCLUSIVE LICENSING
Updated: October 2, 2026
Marcus D Beats is operated by Omega Music LLC, based in Orting, Washington, USA. These terms apply to marcusdbeats.com and its store purchases. Review the product details and the specific lease agreement offered for your selected beat and tier before purchase. A separately agreed written license governs the rights granted for that transaction.
Product-specific terms: Beat-lease provisions on this page apply to beat purchases. Sound kits and Original Samples follow the usage and sample-clearance terms on their respective product pages. Beat-lease tier prices, limits, and agreement PDFs do not apply to those products.
1. Non-exclusive leases only
Standard beat purchases are non-exclusive beat leases. A lease permits the agreed use of a beat within the selected agreement. It does not transfer ownership or copyright in the original beat, its master recording, or its underlying composition.
Marcus D and any identified co-owners retain their existing rights. Other artists may license the same beat, and the beat may remain available after purchase. Any exclusive rights or individually negotiated arrangement require a separate written agreement with Marcus D; no store tier automatically grants exclusivity.
2. Pricing and selected license
Non-exclusive leases start at $500. The current regular tiers are Basic $500, Standard $850, Premium $1,500, and Unlimited $2,500. Confirm the price, currency, selected license, and total shown at checkout. The tier name alone does not define its rights or waive restrictions.
- Basic — $500: WAV; 300,000 audio streams; 5,000 paid downloads/physical copies; 1 full music video; 300,000 combined video plays; 2-year term.
- Standard — $850: WAV and stems/trackouts; 500,000 audio streams; 10,000 paid downloads/physical copies; 2 full music videos; 500,000 combined video plays; 3-year term.
- Premium — $1,500: WAV and stems/trackouts; 1,000,000 audio streams; 25,000 paid downloads/physical copies; 3 full music videos; 1,000,000 combined video plays; 5-year term.
- Unlimited — $2,500: WAV and stems/trackouts; unlimited audio streams, paid downloads/physical copies, full music videos and video plays; 7-year term.
All allowances apply during the license term. Paid downloads and physical copies share one sales cap. Monetized and non-monetized video plays, including social promotional clips, share one video cap across platforms. Audio and video caps are separate. All tiers permit unlimited paid and unpaid live performances, radio plays and free downloads during the term. Social promotional clips are permitted; film, television-program, video-game and third-party advertising placements require a separate agreement. Unlimited does not mean perpetual, exclusive or unrestricted rights.
The selected agreement determines included files, the number of permitted new songs, duration, territory, distribution, audio and video streaming limits, performances, radio, synchronization, monetization, and any other conditions. Obtain written approval before using a beat beyond that agreement or exceeding a limit.
3. Ownership, royalties, and credits
A lease fee is not a copyright buyout and does not automatically waive royalties, publishing interests, or other obligations. The new song’s composition, writer’s share and publisher’s share are each allocated 50% to Producer and 50% to Licensee, with each party controlling and administering its own publishing share. Ownership of the original beat, your new material and the resulting recording, producer participation, mechanical royalties and accounting remain governed by the specific agreement.
Provide the producer and contributor credits required by your license. Registrations and distribution metadata must accurately reflect the agreed ownership and shares. Do not claim another party’s rights as your own.
As between the parties, the buyer owns the new finished recording, subject to the retained rights in the incorporated beat, the selected lease and third-party contributions. Ownership of the finished recording does not extend the license term or transfer the original beat.
4. Previews, files, and delivery
Public previews are for listening and choosing a beat. They are not licensed for release, reuse, or distribution. Use only the files delivered for your purchased license and its permitted purposes.
MP3, WAV, stems, lyrics, artwork, and other extras are included only when expressly listed or separately agreed. Download availability and any expiry depend on the product and agreement. Keep a copy of your receipt, final license, and delivered files. Contact us with your order number if a file is missing, incorrect, corrupted, or inaccessible.
After payment is confirmed, account customers can find audio files under My Downloads and the license agreement PDF inside their paid order under My Purchases. Guest customers can use the file and agreement links in their paid order email. Contact support if an email or purchase is missing.
5. Content ID and third-party material
Basic, Standard and Premium leases prohibit registration of the beat or resulting song with YouTube Content ID, including enrollment through a distributor or aggregator. Permission requires a purchased Unlimited license for the beat or exclusive rights purchased under a separate written agreement with Marcus D. Unlimited permission applies during its license term and remains non-exclusive. Permission is subject to YouTube and service-provider eligibility requirements; it does not guarantee acceptance. YouTube excludes non-exclusively licensed material from Content ID references. Do not claim, block, monetize or otherwise interfere with Marcus D’s authorized uses or those of other authorized licensees, and promptly release erroneous claims. Other automated content-identification systems require separate written permission. Ordinary distribution within the license is permitted without enrollment in a prohibited claiming system.
Producer is responsible for permissions needed for third-party material supplied in the beat to be used as the agreement permits. Buyers are responsible for material they add and uses outside the agreement. Any exception must identify the affected material and be disclosed and expressly agreed in writing before purchase. Unresolved clearance must be addressed before public release. A lease does not transfer third-party ownership, and automated platform claims cannot be ruled out by a store purchase.
6. Restrictions and custom work
Do not resell, redistribute, sublicense, give away, or transfer the standalone beat or stems unless separately authorized in writing. Files may be shared with collaborators and service providers only as permitted and needed for the licensed project, without independent reuse.
Edits, mixing, mastering, custom production, and revisions are not automatically included in a lease. Request and agree any additional services before purchase or release.
7. Payments, support, and refunds
Use an available checkout payment method and provide accurate order and billing details. Review any applicable charges shown before completing payment.
If you have a delivery or technical problem, contact us with the beat title and order number so we can help. Refund requests are assessed under the terms applicable to your purchase and mandatory consumer law. Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded.
8. Website use and privacy
Use the website lawfully. Do not interfere with its operation, misuse another person’s account, infringe intellectual property rights, or redistribute store content without permission. You must have the authority and any legally required consent to enter your purchase and license agreement. Our Privacy Policy explains the handling of personal information.
9. Updates and existing purchases
Store information may be updated for future purchases. Updates do not retrospectively change rights already granted under an earlier agreement. Any extension, amendment, or separate rights arrangement must be documented with the relevant parties.
Licenses do not renew automatically. Arrange a written renewal before expiry or stop further exploitation requiring the license, including instructing distributors and platforms to remove the song from further public availability. A later exclusive sale does not cancel an existing valid lease. An otherwise compliant lease cannot be cancelled merely by offering a refund; contractual breach remedies remain available.
